Do You Need a License?
The City of Kimmswick requires all commercial businesses/persons physically located and operating within the City of Kimmswick city limits to obtain a license prior to conducting such business or occupation from Kimmswick City Hall.
It shall be unlawful for any person, firm or corporation to engage in any business or occupation in the City of Kimmswick without having first applied for and obtained a license to conduct such business or occupation from the City Clerk and without paying the license fee therefor, all as provided for in this Chapter. Where more than one (1) business shall be conducted on the same premises, each such business shall be licensed. The sale of food shall always constitute a separate business from any other business carried on at such premises per Kimmswick City Ordinance 605.010. Types of Licenses and Fees
Every business planning to operate from a location within Kimmswick City Limits is required to obtain a Business (Merchant) License. The annual fee is fifty dollars ($50.00) per year. Where more than one (1) business shall be conducted on the same premises, each such business shall be licensed at the rate of $50.00 per business each year per Kimmswick City Ordinance 605.010.
The sale of food shall always constitute a separate business from any other business carried on at such premises per Kimmswick City Ordinance 605.010. Every business conducting the sale of food, operating from a location within Kimmswick City Limits is required to obtain a Food License. The annual fee is fifty dollars ($50.00) per year.
The term of the licenses issued pursuant to the provisions of Kimmswick City Ordinance shall be from Jul 1 to June 30 of the following year.
Renewals are due by July 1st. It is the responsibility of each licensee to renew their license by the expiration date.
Any merchant/business that does not renew their license by this date is subject to a penalty fee as follows:
- Renewal from July 15 – August 15: twenty-five dollars ($25.00) penalty.
- Renewal from August 16 – September 15: fifty dollars ($50.00) penalty.
- Renewal after September 16: seventy-five dollars ($75.00) penalty.
The penalty shall be in addition to the regular renewal fee of EACH LICENSE. Any merchant/business having more than one license shall be subject to a penalty fee on each late renewal.
License Fee for Temporary Business
Display of License
Any applicant for a business license shall be required to be properly licensed and inspected before opening and conducting business. Each license issued by the City of Kimmswick shall be carefully preserved and shall be displayed in a conspicuous place in the place of business authorized to be conducted by said license. If there is no place of business, said license shall be carried on the licensee’s person.
Revocation of License-Grounds
A. Any license issued by the City pursuant to the provisions of this Chapter may be revoked by the Board of Aldermen for any of the following reasons, as well as for any other reasons specified in this Chapter:
- Any failure to comply with or any violation of any provisions of this Chapter, or any other ordinance of the City regulating the business, occupation or activity licensed, or the Statutes of the State of Missouri by any licensee; or
- Violation of the terms and conditions upon which the license was issued; or
- Failure of the licensee to pay any tax or obligation due to the City; or
- Any misrepresentation or false statement in the application for a license required herein; or
- Failure to display the license required herein
B. Revocation of any license shall be in addition to any other penalty or penalties which may be imposed pursuant to these provisions.
